Terms of Service

1. Provider and scope

These Terms of Service ("Terms") govern the use of the RS-Flipper website (rs-flipper.com), API and RuneLite plugin (together the "Service"), operated by [FULL NAME], [STREET AND NUMBER], [POSTAL CODE, CITY], Germany ("we", "us") - see the Imprint. The Service is directed at consumers within the meaning of § 13 of the German Civil Code (BGB). Deviating terms of the user do not apply.

2. Description of the Service

RS-Flipper is an assistance tool for trading on the Grand Exchange of the game Old School RuneScape. The Service analyses publicly available market data as well as the game state transmitted by your plugin and generates trading suggestions, tracks completed trades and provides statistics and alerts.

3. Account and use

Use of the Service requires a free account (email or Discord sign-in). You must provide accurate information and keep your credentials confidential. Accounts are personal; sharing an account with third parties is not permitted. We never ask for your RuneScape login credentials.

4. Launch period; future paid features

During the current launch period, all features of the Service are provided free of charge. We plan to introduce paid premium features in the future. The introduction of paid features will not create any payment obligation for existing accounts: paid features will only be available after you expressly order them at the prices communicated at that time, including all statutory consumer information. A free tier will remain available. There is no entitlement to the continued availability of individual free features.

5. User obligations

In the event of serious or repeated violations, we may temporarily suspend or permanently ban the account concerned; statutory rights remain unaffected.

6. Availability

We provide the Service with reasonable care but do not warrant uninterrupted availability. Maintenance, further development, capacity limits and disruptions of third-party services (e.g. game or market data sources) may lead to temporary restrictions. The Service is under active development; features may change.

7. Intellectual property

All rights to the Service, in particular to the suggestion engine, software, design and content, remain with us or our licensors. You receive a simple, non-transferable right to use the Service for private purposes for the duration of your account. The plugin's published source code is licensed separately under the BSD-2-Clause licence in its public repository.

8. Liability

We are liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, and under the German Product Liability Act.

For slight negligence we are liable only in the event of a breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the user regularly relies - so-called Kardinalpflichten), and limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

For clarity: losses of in-game currency or items resulting from trading decisions do not constitute damage for which we are liable under these Terms; trading suggestions are non-binding (see section 2).

9. Term and termination

The user contract runs for an indefinite period. You may terminate it at any time by deleting your account in the account settings. We may terminate the free contract with reasonable notice; the right to suspend or ban accounts for cause (section 5) remains unaffected.

10. Changes to these Terms

We may amend these Terms for the future where this is necessary for valid reasons (e.g. changes in law, new features) and the amendment is reasonable for the user. We will announce amendments in good time in text form (e.g. on the website or by email). If you do not agree, you may terminate the contract at any time free of charge (section 9).

11. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

12. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another EU member state, the mandatory consumer protection provisions of that state remain unaffected (Art. 6 Rome I Regulation). Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
